I don't smoke at all and if you have a strange look on your face, much less a cigarette in your mouth, you're lucky to even get NEAR the VX.
I used to be deathly allergic to cigarette smoke so I'm a little biased, but I firmly believe that if you are in your own home or vehicle it is totally your decision whether you want black lung or not (smoke 'em if you got 'em).
Here in Colorado, at least my part, we have banned smoking in bars and other public places. I don't think that there is a ban on smoking outside, yet, but you know how us granola eating, tree hugging, mountain folk can be and I'm sure that it's not far behind.
Seriously, though, I don't believe that the government (or anyone else for that matter) has a right to tell you what to do with your own body in your own home. As long as you aren't hurting others with your behavior then have at it.
